STATEMENT OF RIGHTS AND RESPONSIBILITIES
This is version 1 of our Statement of Rights and Responsibilities dated 15 October 2011.
Please read this Statement of Rights and Responsibilities ("Statement") carefully. It governs our relationship with users and others who interact with Qualitysheet/Skyguests. By using or accessing Qualitysheet or Skyguests, you, personally or on behalf of the legal entity of which you are a representative, an agent or employee when acting in such capacity, agree to this Statement. Please check regularly for updates.
1. Purpose
Qualitysheet’s mission is promoting interaction between customers and brands. We believe in open communication and stimulate customers to share feedback and ideas with their brands. Customers should be a brands’ prime ambassadors. To achieve this mission, Qualitysheet offers various services that enable interaction between brands and their customers.
Skyguests is a Qualitysheet service targeted to airline communities. When these terms refer to Qualitysheet, they do include the Skyguests service.
2. Privacy
Your privacy is very important to us. We designed our Privacy Policy to make clear what content we store and what we do with the information on Qualitysheet. We encourage you to read our Privacy Policy.
3. Code of Conduct
As a condition to use Qualitysheet, you must strictly observe the rules set forth in the Code of Conduct. Qualitysheet may, at its sole discretion, immediately block or remove your content and/or terminate your account and even refuse to deliver future services to you, should your conduct fail to conform with the Code of Conduct.
If we remove your content as set forth above, and you believe we removed it by mistake, we will provide you with an opportunity to appeal.
You will not transfer any of your rights or obligations under this Statement to anyone else without our consent.
4. Sharing Your Content and Information
You own the information you post on Qualitysheet, and may request its deletion at any time, unless you have shared information or content with others and they have not deleted it, or it was copied or stored by other users. Additionally, you grant Qualitysheet a nonexclusive, irrevocable, worldwide, perpetual, unlimited, assignable, sublicenseable, fully paid up and royalty-free right to us to copy, prepare derivative works of, improve, distribute, publish, remove, retain, add, process, analyze, use and commercialize, in any way now known or in the future discovered, any information you provide, directly or indirectly to Qualitysheet, including but not limited to any user generated content, ideas, concepts, techniques or data, you submit to Qualitysheet, without any further consent, notice and/or compensation to you or to any third parties. Any information you submit to us is at your own risk of loss.
By providing information to us, you represent and warrant that you are entitled to submit the information and that the information is accurate, not confidential, and not in violation of any contractual restrictions or other third party rights. Qualitysheet is not envisioned as a closed system. Qualitysheet thinks that your ideas and feedback are valuable and will share them throughout the internet via widgets and other means. However, Qualitysheet will not share your personal data as set forth in our Privacy Policy.
Prior to posting any information or ideas on Qualitysheet you must realize that this information and ideas may and will be used by third parties for their own benefit, without these parties having any obligation to remunerate you. Don’t share any information or ideas you don’t want to disclose.
5. Setting up a Community
Both the customers (fans) of a brand and the owners of a brand can create and/or lead a brand community. In doing so, you need to adhere to our terms on Setting up a Community. You must review these terms and comply with them.
6. Brand Policy
Brands are the valuable commercial asset of their owners and must be respected at all times. When using Qualitysheet you must at all times respect our Brand Policy. You must review it and comply with it.
If you own or represent a brand and you feel like your intellectual property rights have been infringed upon, you can file a complaint as set forth under our Complaint Procedure.
7. Payments
If you make a payment on or to Qualitysheet or if you seek payment from community members via Qualitysheet/Skyguests, you agree to our Payments Terms. You must review these terms and comply with them.
8. Complaints
We require users to operate in according with this Statement and the Code of Conduct. If you have a complaint, please contact us via the applicable procedure:
- Claims regarding Infringement of Intellectual Property.
- Claims regarding Privacy.
- Other claims then regarding Intellectual Property or Privacy.
9. Third party websites and services
Qualitysheet contains links to websites published by third parties. Links, widgets or webservices to the Qualitysheet website and services may also be included on third party websites. We have not reviewed these and decline any liability for any information or materials posted on any of the sites linked to our website. By creating a link to a third party website or by tolerating that a third party website includes a link, widget or webservice to our website or service, Qualitysheet does not endorse or recommend any products or services offered on that third party website. Nor does Qualitysheet express any implied or explicit appreciation as to the accuracy and / or reliability of the information to be found, directly or indirectly, on any third party websites or as to the reliability of any third parties.
10. Availability of the Qualitysheet Services
Not all products and services are available in all geographic areas. Your eligibility to receive any product or service may be subject to approval by Qualitysheet or its relevant subsidiary or affiliate. Persons accessing, visiting or using the Qualitysheet website or services must satisfy themselves that the laws of their own country allow them to access the information or must refrain from accessing, visiting and/or using our website and services accordingly.

If we use the word "Qualitysheet" we either refer to our company or to the features and services we make available, including through (a) our website at www.qualitysheet.com and www.skyguests.com any other Qualitysheet branded or co-branded websites (including sub-domains, international versions, widgets, and mobile versions) or (b) our APIs and services that enable others, including application developers and website operators, to retrieve data from Qualitysheet or provide data to us.
We are entitled to transfer our rights and obligations under any agreement with you to a third party.
12. Liability
The information, material and ideas on Qualitysheet are provided for your convenience and are to be used for informational purposes only. You acknowledge that the information, material and ideas that are published on or through Qualitysheet in this respect do not purport to contain all of the information that an interested party may desire. In all cases, you should conduct your own investigation and analysis of the marketing instruments described in these documents and of the data set forth in them.
Because of the volume of information processed by the users of Qualitysheet, it is not possible for Qualitysheet to check and update the information, material and ideas contained in or processed through Qualitysheet and to assess the reliability of their sources. Consequently, Qualitysheet does not guarantee the accuracy, adequacy, completeness, timeliness or fitness for any specific purpose of the information, material and ideas included or referred to in Qualitysheet or the reliability of their sources. Any use is at your own risk. QualitySheet, its parent companies, subsidiaries, affiliated entities, directors, employees and agents shall not have any liability, on whatever basis, contractual or not, for any direct or indirect damages you may incur arising from the access to, visit or use of Qualitysheet.
The responsibility for the correctness and legality of the information, material and ideas on Qualitysheet remains at all times with the user that posted such information, materials or ideas on Qualitysheet directly or indirectly via a widget or webservice.

WE ARE PROVIDING QUALITYSHEET "AS IS" WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT QUALITYSHEET WILL BE SAFE OR SECURE. QUALITYSHEET IS NOT RESPONSIBLE FOR THE ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES, AND YOU RELEASE US, OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM YOU HAVE AGAINST ANY SUCH THIRD PARTIES. OUR AGGREGATE LIABILITY ARISING OUT OF THIS STATEMENT OR QUALITYSHEET WILL NOT EXCEED THE GREATER OF ONE HUNDRED EURO (€100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS. APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY OR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN SUCH CASES, QUALITYSHEET'S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
13. Intellectual Property Rights
The information on Qualitysheet is protected by intellectual property rights, including but not limited to copyright, know-how, business names, trademarks, patents and design rights which are owned by Qualitysheet or third parties. The information on Qualitysheet may be displayed and printed exclusively for your personal, non-commercial use, provided that you retain all copyright and other proprietary notices contained in or on or relating to such information. You shall not otherwise distribute, modify, transmit, reproduce, re-use, re-post or sell any information or material contained in Qualitysheet, in any form, and by any means, without the express prior written consent of Qualitysheet.
14. Governing Law and Jurisdiction
Your access to, visit of and use of Qualitysheet, and this Statement are governed by and shall be construed in accordance with the laws of Belgium. The Courts of Brussels, Belgium shall have exclusive jurisdiction over any dispute relating thereto.
15. Severability and Changes
If any of the provisions of this Statement are held to be unenforceable, the remaining provisions shall be unaffected and the unenforceable provision shall be replaced by such enforceable provision as comes closest to the purpose underlying the unenforceable provision. This Statement shall be subject to any other agreements in writing you have entered or may enter into with QualitySheet or any of its affiliated entities. If we fail to enforce any of this Statement, it will not be considered a waiver.
QualitySheet may modify this Statement at any time, with immediate effect and without prior notice.
